Terms of Service
These terms are an agreement between you and Eeronautic, LLC (“we,” “us”), the operator of Bobber, covering the Bobber mobile apps and website (the “service”). By creating an account or using the service you agree to these terms and to our Privacy Policy. If you don’t agree, don’t use Bobber.
1. Who can use Bobber
You must be at least 13 years old, and old enough in your country to form a binding contract or have a parent or guardian agree on your behalf. You’re responsible for your account, for keeping your sign-in credentials secure, and for activity under your account. Give us accurate information and tell us if you suspect unauthorized access.
2. Fishing conditions and species suggestions are guidance only
Use your own judgment. Your safety is your responsibility.
- Forecasts, tides, marine and stream conditions, and “personal matches” are informational and come from third-party data and your own history. They can be incomplete, delayed, or wrong, and similar conditions do not guarantee a similar result. Bobber is not a navigation, weather-warning, or safety tool. Never rely on it to decide whether it is safe to go out, to launch a boat, to wade, or to stay on the water. Check official sources and local conditions.
- Species suggestions are generated automatically from photos and may be inaccurate. Don’t rely on them to decide whether a fish is safe to eat, legal to keep, or protected. You’re responsible for confirming species, size and bag limits, seasons, closures, licenses, and permits under the rules that apply where you fish.
- Map data, boundaries, and locations are approximate. Respect private property, protected areas, and posted restrictions.
3. Your content
You own the catches, photos, notes, waypoints, and other content you add (“your content”). You give us a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content solely to operate, secure, and improve the service for you, including sending photos and notes to the service providers described in our Privacy Policy to generate suggestions you asked for. This license ends when you delete the content or your account, except for short-lived backups.
You’re responsible for your content and confirm that you have the right to upload it, including photos taken by others. Don’t upload content that is unlawful, infringing, or that contains other people’s private information without permission.
4. Acceptable use
You agree not to:
- Break the law or violate others’ rights when using the service.
- Interfere with, overload, or attempt to gain unauthorized access to the service, its servers, or other users’ data.
- Reverse engineer, scrape, or extract data from the service in bulk, or circumvent limits, quotas, or paywalls.
- Use automated means to create accounts or to call the service, including identification features, other than through the app.
- Resell or commercially exploit the service without our written permission.
5. Bobber Pro subscription
Bobber is free to use with limits on some features. Bobber Pro is an optional auto-renewing subscription that removes those limits and unlocks Pro features. Current features and limits are shown in the app at the time you subscribe and may change.
- Price and term. The current price is shown in the app before you subscribe, in your local currency: at launch, US$59.99 per year. Prices may vary by region and can change; we’ll give notice of a price change as required by Apple and applicable law.
- Billing. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Managing and canceling. Manage or cancel in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app or your Bobber account does not cancel your subscription.
- Refunds. Purchases are processed by Apple, and refund requests are handled by Apple at reportaproblem.apple.com. Except as required by law, subscription fees are non-refundable.
- Restore. You can restore an existing subscription in the app on a new device signed in to the same Apple ID and Bobber account.
- If Pro ends. Your existing catches, waypoints, and areas stay yours to view, edit, and delete. You lose only the Pro features and the ability to create new content beyond the free limits.
6. Apple App Store terms
If you get the iOS app from the Apple App Store, these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for claims relating to it, including product liability, legal or regulatory compliance, or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any, and Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you’re not located in a country subject to a U.S. government embargo or listed on a U.S. government list of prohibited or restricted parties, and you’ll comply with applicable third-party terms (such as your wireless data agreement) when using the app. Apple’s Licensed Application End User License Agreement applies to the extent it is more protective of Apple than these terms.
7. Third-party services and data
The service depends on third-party providers for maps, weather, marine, tide, and stream data, and for sign-in, hosting, and payments. We’re not responsible for third-party services, and their availability and accuracy can change. Their own terms apply when you use them.
8. Our rights
Bobber, including its software, design, logos, and content we provide, is owned by us and our licensors and protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial use in accordance with these terms. We appreciate feedback and may use it without obligation to you.
9. Changes to the service
We’re still improving Bobber. We may add, change, or remove features, including free and Pro features and limits, and may suspend or discontinue the service. If we discontinue the service, we’ll give reasonable notice and a chance to export your data where practical.
10. Termination
You can stop using Bobber and delete your account at any time in Settings → Delete Account. We may suspend or terminate your access if you violate these terms, if required by law, or to protect the service or other users. Sections that by their nature should survive termination will survive, including 2, 8, and 11 to 14.
11. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We don’t warrant that the service will be uninterrupted or error-free, that data will be accurate, or that it will help you catch fish. Fishing and being on or near the water involve inherent risks, and you use the service and fish at your own risk.
12. Limitation of liability
To the fullest extent permitted by law, we won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, or for any injury, loss, or damage arising from your fishing activities or your reliance on forecasts, conditions, or species suggestions. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some jurisdictions don’t allow certain limitations, so some of this may not apply to you, and nothing here limits liability that can’t be limited by law.
13. Indemnity
You agree to indemnify us against claims arising from your content or your violation of these terms or applicable law, to the extent permitted by law.
14. Governing law and disputes
These terms are governed by California law, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Monterey County, California, and you consent to their jurisdiction, unless applicable law gives you the right to bring a claim in your home jurisdiction. Please contact us first at hello@eeronautic.com so we can try to resolve the issue informally.
15. Changes to these terms
We may update these terms. We’ll change the effective date above and, for material changes, notify you in the app or by email. Continuing to use Bobber after changes take effect means you accept them.
